Booking, Payments & Currency Adjustments
Payment Schedule
A non-refundable deposit of 30% of the total tour cost is required at the time of booking to secure reservations. The remaining balance must be paid in full no later than 60 days prior to the departure date.
Price Volatility & Surcharges
Quotations are based on prevailing exchange rates, statutory taxes, fuel costs, and park entry fees at the time of booking. Curated Tours reserves the right to pass on pre-departure price increases resulting from foreign exchange volatility, official tax modifications, or revised lodge and park tariffs.
Cancellation Policy — Cancellations must be communicated in writing. The following tiered cancellation penalties apply:

Acknowledgement & Assumption of Inherent Activity Risk
You acknowledge that participation in tours, safaris, and related travel activities organised or facilitated by Curated Tours involves inherent risks. These include, but are not limited to:
- Transport delays, accidents, or disruptions across road, air, and water transit.
- Wildlife encounters, remote safari environments, and uneven terrain.
- Unpredictable weather conditions and natural hazards.
- Political, civil, and security risks — including elections, demonstrations, protests, strikes, civil unrest, roadblocks, curfews, and government directives.
Voluntary Participation & Activity Risk Assumption — You explicitly acknowledge that tour activities — including walking safaris, water-based activities, mountain trekking, hot air ballooning, wildlife encounters, and optional self-selected excursions — carry inherent, unavoidable hazards. Participation in any activity during the tour is undertaken entirely at your sole discretion and risk. Curated Tours and its Released Parties shall bear no liability for any personal injury, illness, disability, death, or property damage resulting from risks inherent to these activities or your voluntary choice to partake in them.
Comprehensive Force Majeure & Election Disruption Allocation
Force Majeure Event Definition
Includes election-related disruptions, civil unrest, political campaigning, demonstrations, strikes, roadblocks, curfews, border closures, government directives, acts of war or terrorism, severe weather, or public health emergencies outside Curated Tours' control.
Financial Allocation & Non-Refundability
If a tour is postponed, modified, or cancelled due to Force Majeure, Curated Tours is not liable for cash refunds. Curated Tours will issue a credit voucher equal to the recoverable portion of booking funds, net of unrecoverable third-party expenses (e.g., non-refundable safari lodge deposits, flight tickets, and wildlife permits) and administrative expenses.
Release of Liability
You hereby release, waive, discharge, and hold harmless Curated Tours, its directors, owners, employees, agents, guides, drivers, and affiliated service providers (collectively, the "Released Parties") from any liability, claims, or demands arising from:
- Personal injury, illness, disability, or death.
- Loss, theft, or damage of personal property.
- Delays, cancellations, diversions, or itinerary changes beyond company control.
- Actions, omissions, defaults, or negligence of third-party service providers (including airlines, hotels, transport operators, and independent activity providers).
East Africa Regional Travel, Health & Fitness Compliance
Fitness to Travel
By booking, you confirm that you and all participants are physically and medically fit to take part in the booked activities. You accept responsibility for any medical conditions, injuries, or complications that may occur during the trip, whether disclosed or undisclosed.
Cross-Border Documentation
Participants are solely responsible for securing valid passports (minimum 6 months validity from the return date), required visas (including East Africa Tourist Visas where applicable), and re-entry permits across Kenya, Tanzania, Uganda, and Rwanda.
Medical & Health Compliance
Participants must obtain all mandated regional medical documentation, including Yellow Fever certificates and health declarations. Curated Tours accepts no financial or logistical liability for border delays, deportation, quarantine, or entry refusals imposed by immigration or health authorities.
Travel Insurance
Curated Tours strongly recommends that you purchase comprehensive travel insurance for the full duration of your tour. Appropriate cover should include medical expenses, emergency evacuation, trip cancellation and interruption, and protection for personal belongings. Curated Tours is not an insurer and is not liable for costs, losses, or expenses not covered by your insurance policy.
Indemnity Agreement
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Released Parties against claims, liabilities, damages, losses, penalties, costs, and expenses — including reasonable legal fees — arising from your breach of these terms, negligent or unlawful acts, or claims made by a third party arising from your conduct during the tour.
Dispute Resolution, NCIA Arbitration & Forum Selection
Governing Law
These terms are governed by and construed in accordance with the laws of Kenya.
Dispute Resolution
Any dispute arising from or in connection with a tour shall first be submitted to informal mediation. If unresolved within 30 calendar days, the dispute shall be referred to binding arbitration under the rules of the Nairobi Centre for International Arbitration (NCIA) in Nairobi, Kenya.
Exclusive Jurisdiction
Participants irrevocably waive the right to institute legal proceedings against the Released Parties in foreign courts outside Kenya.
Data Protection & Media Release
Data Privacy Consent
Pursuant to the Kenya Data Protection Act, you explicitly consent to the collection and processing of your personal details, passport copies, and medical disclosures necessary for itinerary execution, third-party reservations, and emergency assistance.
Media License
You grant Curated Tours a perpetual, royalty-free licence to use photos and video footage taken during the tour featuring your likeness for promotional and marketing materials, unless an explicit written opt-out is submitted to Curated Tours prior to departure.
